Terms and conditions

§1 General provisions

1. These terms and conditions, hereinafter referred to as the “Terms and Conditions,” set out the rules for enrolling in courses and using the online store located at the following website: https://akademiavca.nl, hereinafter referred to as the “VCA Academy.”
2. The VCA Academy is operated by the company: Akademia VCA, 3125 BJ Schiedam, `s-Gravelandseweg 397, Nederland, registered in the Netherlands under KvK number: 64597237, hereinafter referred to as the “Administrator”.
3. Any natural person with full legal capacity, legal entity or organizational unit without legal capacity, but with legal capacity under the law, interested in using the services of the VCA Academy, by registering on the VCA Academy website or placing an order, becomes its Customer and declares that they have read these Terms and Conditions and agree to comply with them.
4. All prices quoted on the VCA Academy website are in euros and include (unless otherwise stated) 21% BTW (VAT).
5. Promotions offered by the VCA Academy cannot be combined. The Customer may only take advantage of one promotion, unless the terms and conditions of the promotion expressly provide for the possibility of combining several promotions.

§2 Products and services

1. The VCA Academy website sells courses and exams, as well as teaching materials such as books, e-books, and exam question sets for self-study.
2. The term “full course” means 8 or 12 hours of lectures plus a computer exam held at the training center.
3. The term “exam” means a computer exam held at the training center.
4. The date of the full course or exam means the specific date and time of the start of the full course or exam.

§3 Registration for a course or exam

1. In order to register for a full course or exam, you must complete the order form on the VCA Academy website and pay the applicable fee.
2. The candidate is required to complete the order form for the full course or exam in a complete and correct manner, providing information that is true and accurate.
3. The fee for the full course consists of two parts: the exam fee and the course fee.
4. The exam fee consists of one part: the exam fee.
5. In order to participate in the full course, the minimum exam fee must be paid at least 48 hours before the start of the course. The course fee must be paid on the day of the course, before it starts. By bank transfer, cash or card to the course instructor.
6. The exam fee must be paid no later than 56 hours before the start of the exam in order to take the exam.
7. Immediately after the funds have been credited, the VCA Academy will inform the Candidate of the receipt of the order and the registration of the candidate for the course by sending an appropriate confirmation to the Candidate’s e-mail address. The procedure for registering the Customer in the VCA exam database will also be initiated.
8. If the exam fee is not paid within the required time, the registration procedure will not be initiated and the Candidate will not be admitted to the exam.
9. Failure to take the exam or absence from the course that has not been reported at least 24 hours before the start of the full course or 36 hours before the start of the exam is not grounds for a refund of the exam fee.
10. The date of the full course or exam may be changed, and the full course or exam may be canceled no later than 24 hours before the start of the full course or 36 hours before the start of the exam. In the event of cancellation within the required time, the course or exam fee will be refunded within 7 days.

§4 Placing orders for other products

1. In order to make a purchase, you must complete the order form on the VCA Academy website and pay the appropriate fee.
2. The customer is obliged to complete the order form in a complete and correct manner, providing data consistent with the actual state of affairs.
3. Orders for teaching materials can be placed 24 hours a day.
4. The order shall be considered accepted for execution after confirmation by the VCA Academy of acceptance of the order placed by the Customer.
5. The Customer and the VCA Academy are bound by the price valid at the time of placing the order by the Customer.

§5 Payments and order fulfillment

1. VCA Academy accepts the following forms of payment:
   • payment card/online transfer – payment is made via the PayPal or Mollie payment system in real time;
   • bank transfer – payment is made by the Customer transferring the order value to the VCA Academy’s bank account provided after placing the order, with the date of payment being the date on which the funds are credited to the VCA Academy’s account.
2. In the case of downloadable Products, information about the possibility of downloading the ordered Products, together with a link, is sent to the Customer to the email address provided when placing the order.
3. The invoice shall be issued within 7 days of the date of payment in full or after the end of the course.
4. The Customer is obliged to provide the data necessary for the correct issuance of the invoice, in accordance with the applicable regulations.

§6 Complaints

1. Complaints regarding the ordered Products may be submitted via the contact form on the website or by post, within 7 days from the date of the event justifying the return. The complaint should include the following information: the Customer’s first and last name, address, order number, date of order, subject of the order, reason for the complaint, and the Customer’s contact information, as well as confirmation of purchase of the Product being complained about (e.g., invoice, transfer confirmation).
2. Complaints submitted by the Customer will be considered within 14 days of their submission.
3. The decision on the complaint will be sent by email to the email address provided by the Customer.
4. We do not accept complaints regarding failed exams.

§7 Technical requirements

1. Use of the VCA Academy website by the Customer requires:
   • access to the Internet,
   • a web browser (recommended browsers: Microsoft Internet Explorer from version 8.0, Mozilla Firefox from version 6.0, Opera from version 12.0, Google Chrome from version 20.0, and Safari from version 5.1),
   • having an active and functional e-mail account for receiving e-mail messages.
2. The installation of the software referred to in paragraph 1 is subject to a separate license agreement between the Customer and the licensor, the creator of the specific program.
3. For the proper functioning of the VCA Academy website, it is also necessary that the Customer’s IT systems have cookies enabled and JavaScript enabled.
4. When the Customer visits the VCA Academy website, the IT system sends at least one cookie to the Customer’s computer. For more information about cookies and how we use them, please refer to the Privacy Policy.

§7 Copyright

1. All photos, their descriptions and other visual or textual materials posted on the VCA Academy website, unless otherwise indicated, are the property of the Administrator, or the Administrator has the exclusive or non-exclusive right to publish them.
2. It is prohibited to reproduce or distribute in any form the materials specified in section 1 above without the prior written consent of the Administrator.

§8 Personal data protection

1. By completing the purchase form and ticking the box, the Customer consents to the collection and processing of their personal data by the Administrator for the purposes necessary to implement the provisions of these Terms and Conditions and the services provided on the basis thereof.
2. The administrator of personal data is Akademia VCA.
3. Only personal data provided voluntarily by the Customer for the purposes necessary to perform the provisions of these Terms and Conditions and the services provided on their basis are collected.
4. Each Customer who registers or places an order agrees to receive information related to the progress of the order and notifications of changes to these Terms and Conditions to the email address provided by them.
5. Other information regarding the operation of the VCA Academy websites, as well as commercial information about new products, services, and promotions of the VCA Academy, will only be sent to those Customers who have given their consent.
6. The store administrator informs that the Customer is not obliged to provide their personal data, however, refusal to provide such data will prevent the performance of services specified in the Terms and Conditions towards the Customer.
7. The collected data is protected in accordance with applicable regulations.
8. The Customer has the right to access their personal data at any time, as well as the right to correct it and request its removal. This right can be exercised by sending a signed request to the Administrator’s address.

§9 Final provisions

1. The Administrator of the VCA Academy reserves the right to amend the provisions of these Regulations.
2. In the event of changes to the Regulations, the VCA Academy will inform Customers of the changes and the date on which they will come into force by publishing the consolidated text of the Regulations on its website at least 7 days before that date.
3. Orders placed before the date of entry into force of the amendments to the Terms and Conditions shall be subject to the provisions of the previously binding Terms and Conditions. The Customer accepts the amendments to the Terms and Conditions by using the VCA Academy website after the date of entry into force of these amendments. If the Customer does not accept the amendments to the Terms and Conditions, they may withdraw from using the VCA Academy website and request the deletion of their account created in the store and the cessation of the processing of their personal data.
4. In the event of a change or invalidation, as a result of a final court ruling, of any provision of these Terms and Conditions, the remaining provisions shall remain in force and binding on the parties.
5. The Administrator reserves the right to interrupt the operation of the website due to maintenance, reconstruction or modernization. In addition, in the event of technical interruptions, Akademia VCA will post an appropriate message on the website indicating the estimated time of the restrictions on the availability of the website.
6. The Terms and Conditions shall enter into force on May 1, 2018.
